COBRA Links

The Department of Labor published final regulations on COBRA's notice requirements, setting minimum standards for the timing and contents of the notices required under COBRA and providing model notices. The final regulations apply to notice obligations arising on or after the first day of the first plan year beginning on or after November 26, 2004 (calendar year plans must comply as of January 1, 2005).

A number of changes to the regulations and model notices were made to the general notice requirements, qualified beneficiaries' notices, and plan administrator's notice obligations in response to the public comments received on the proposed rule released May 27, 2003. Like the proposed rule, the final rule includes four separate sections:
